These Terms of Service ("Terms") constitute a legally binding agreement between you ("User" or "you") and Katarzyna Radan ("Service Provider," "we," "us," or "our"), regarding your use of the Beauty AI mobile application (the "App"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App. 1. MEDICAL AND COSMETIC DISCLAIMER (IMPORTANT) 1.1 No Medical Advice The App uses Artificial Intelligence to analyze skin conditions and suggest cosmetic products. THIS IS NOT A MEDICAL DEVICE. The information, analysis, and recommendations provided by the App are for informational and cosmetic purposes only. 1.2 Not a Substitute for Professional Care The App cannot diagnose, treat, cure, or prevent any disease or medical condition (such as eczema, psoriasis, or severe acne). Always seek the advice of a dermatologist or qualified healthcare provider with any questions regarding a medical condition. 1.3 No Guarantees Skin care is highly individual. Products or routines suggested by the AI may not work for everyone and could cause irritation. You use the App and follow its recommendations at your own risk. We are not liable for any adverse skin reactions resulting from the use of recommended products. 2. ELIGIBILITY AND ACCOUNTS 2.1 Age Requirement You must be at least 13 years old to use the App. If you are between 13 and 18, you represent that you have your legal guardian's permission to use the App. 2.2 Account Security You are responsible for maintaining the confidentiality of your login credentials (via Google or Apple Sign-In). You are responsible for all activities that occur under your account. 3. SUBSCRIPTIONS AND PAYMENTS 3.1 Apple In-App Purchases The App offers paid features ("Pro" or "Premium") via Apple In-App Purchases. - Payment is charged to your Apple ID account upon confirmation of purchase. - Subscriptions automatically renew unless turned off in your Apple ID settings at least 24 hours before the current period ends. 3.2 Refunds Because payments are processed directly by Apple, we do not have the ability to issue refunds directly. Refund requests must be submitted to Apple Support in accordance with their refund policies. 3.3 Price Changes We reserve the right to modify subscription fees. Any price changes will take effect at the start of the next subscription period following notice to you (provided by Apple). 4. INTELLECTUAL PROPERTY 4.1 Our Rights The App, including its code, design, algorithms, AI models, and "Beauty AI" branding, is the intellectual property of Katarzyna Radan. You may not copy, modify, reverse engineer, or decompile the App. 4.2 User Content You retain ownership of the photos you upload ("Face Data"). However, by uploading them, you grant us a limited, non-exclusive license to process these images solely for the purpose of providing you with the analysis, as described in our Privacy Policy. 5. PROHIBITED CONDUCT You agree NOT to: - Use the App for any illegal purpose. - Attempt to exploit, reverse engineer, or extract the source code or AI models. - Harass, abuse, or harm another person via the App. - Use the App to transmit viruses or malicious code. - Use automated scripts to collect information from or otherwise interact with the App. 6. PRIVACY POLICY Your use of the App is also governed by our Privacy Policy, which explains how we collect, store, and protect your data (specifically Face Data). By using the App, you consent to the practices described in the Privacy Policy. 7. DISCLAIMER OF WARRANTIES THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT GUARANTEE THAT THE APP WILL BE ERROR-FREE, SECURE, OR ALWAYS AVAILABLE. 8. LIMITATION OF LIABILITY TO THE MAXIMUM EXTENT PERMITTED BY LAW, KATARZYNA RADAN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID TO US, IF ANY, IN THE PAST SIX MONTHS FOR THE SERVICE. 9. INDEMNIFICATION You agree to indemnify and hold harmless Katarzyna Radan and our affiliates from any claims, damages, liabilities, and expenses (including legal fees) arising out of your use of the App or your violation of these Terms. 10. CHANGES TO THESE TERMS We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page or through an in-app notification. Your continued use of the App after the changes constitutes your acceptance of the new Terms. 11. GOVERNING LAW These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates (Dubai), without regard to its conflict of law provisions.
